Federal Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody

A court has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment lacks legal authority.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis wrote in her ruling.

The case originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an error. Following his repatriation to the United States to face alien smuggling allegations, he was detained in federal detention.

In her order, the court pointed out that the authorities lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."

Background of the Case

The court proceedings involve disputed assertions. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.

He has also pleaded not guilty to the smuggling counts, which are part of a separate criminal case in Tennessee.

Terms of Release

The court, who was hearing his challenge to deportation in a federal court, determined that he must now adhere to the conditions of his release from jail in Tennessee. This order effectively transfers his monitoring to the jurisdiction handling his criminal case.
